Terms and Conditions for the Drivers:

According to the Information Technology Act, 2000 and its amendments, these terms and conditions are considered an electronic record under the provisions of electronic records specified in various statutes.

 Please read these terms carefully before using the platform or registering on the platform. If you do not agree with these terms, please do not access the platform, or avail the services.

 

1.GENERAL TERMS:

By accessing and using the MEE CABS App, website, or related services (collectively referred to as the "Platform") provided by SHARADARADHYA Private Limited ("MEE CABS," "Company," "we," or "our"), you acknowledge and accept these terms and conditions (“Terms”) and the Privacy Policy. These Terms supersede any previous agreements and apply to all devices used to access the Platform. Your continued use signifies your acceptance of any updates made by the Company.

 

REGISTRTION ON THE PLATFORM:

1.MEE CABS is the platform on which you may discover the users/passengers/customers and provide services according to their ride request by your own means of willingness in accordance to the terms and conditions of the platform.

2. MEE CABS collects the personal data of the driver, hereinafter referred to as “Driver Information” which includes the driver’s valid vehicle registration, vehicle insurance, driving licence, pollution under control certificate, Aadhar, PAN, Voter ID card as proof of identity, and bank account details.

3.MEE CABS reserves the right to store, process, access and use the driver information for business purposes and needs and any other purposes as MEE CABS may deem fit and in accordance with MEE CABS privacy policy and applicable law. 

  1. By using the Platform, you permit MEE CABS to collect and verify your data per our Privacy Policy. Review it to understand our practices.
  2. All submitted information must be accurate and complete. MEE CABS is not responsible for verifying your data.
  3. You must meet onboarding requirements and provide necessary documents as per MEE CABS policies and laws.
  4. You affirm that:
    1. You have more driving experience of more than 2 years.
    2. No police case/legal issues against you, including cognisable offences in the last 3 years.
    3. No outstanding vehicle-related fines.
  5. You must register on the Platform with accurate information.
  6. Additional documentation may be requested to confirm your identity; failure to verify may limit your access.
  7. You must keep your account details confidential and MEE CABS isn't liable for unauthorized access.
  8. You are accountable for actions under your account and should take reasonable security measures.
  9. MEE CABS isn't liable for security breaches or unauthorized use.
  10. The Company is not liable for app compatibility issues.
  11. You consent to communication from MEE CABS regarding services via electronic methods.
  12. Once registered, you'll be visible to Customers for service requests based on your locations and fees.
  13. Communication with Customers after accepting a request is through the Platform.
  14. The Platform displays a price range based on market price and the route and distance the user has chosen on the platform, with the final price agreed upon between you and the Customer.

4. Not only for the business purposes and needs, we may also provide driver information to a third party, government agency, judicial body, subject to applicable laws and if there is a complaint, dispute or for background check or for any other legal purposes required by the government agencies or third parties.

General Covenant:

You hereby agree that by using the platform:

 

  1. Confirm you are at least 18 years old and legally able to use the Platform.
  2. Provide services honestly and responsibly.
  3.  You will provide the services solely as permitted in these T&Cs.
  4. These T&Cs impose valid and legally binding obligations on you and are enforceable against you.

 

Payment Conditions:

  1. MEE CABS may display an estimated price range based on the market rates that apply to the route and distance the user has chosen on the platform.
  2. MEE CABS makes no guarantee and warranty with respect to the accuracy of the price displayed.
  3.  Subscription fees for Drivers may apply and are subject to taxes.
  4.  Fees agreed upon in the MEE CABS App form a binding contract between Drivers    and Customers.
  5.  Prices may vary; MEE CABS is not liable for discrepancies.
  6.  Payments can be made through the platform or directly in cash.
  7.  Prices displayed are only estimated and for reference only.
  8.  Compensation for lead failures may be deducted from Drivers' fees.
  9. MEE CABS is not liable for payment disputes, and it is not in any way be responsible for the settlement of any payments owed to you by the users or owed by you to the users.
  10. You should check the “includes” and “excludes” section displayed on the platform for any other details regarding the trip.
  11.  The company has the discretion to charge subscription fee or change the platform commission fee as updated on the platform from time to time.
  12. Terms are subject to taxes, and Drivers must handle tax claims.
  13. Additional costs like tolls must be agreed upon.
  14. The Company may modify services at its discretion.
  15. Discounts are final as determined by MEE CABS.

   

 CANCELLATION POLICY:

  1. Once a ride is confirmed, the driver must not cancel the ride under any circumstances, except in cases of genuine emergencies.
  2. Any cancellation by the driver after confirming a ride will result in immediate account deletion from MEE CABS platform.
  3. The driver will forfeit any pending incentives, bonuses, or earnings if their account is deleted due to ride cancellations.
  4. A ride is considered “confirmed” when

a. the driver accepts the ride request on the MEE CABS platform

b. the driver details are shared with the customer for pickup.

  1. After conformation, the driver must proceed to the pickup location   without delay.
  2. In a genuine emergency cases the driver must immediately inform MEE CABS support.
  3. If a driver cancels a ride without a valid reason, he may me blacklisted from rejoining MEE CABS.
  4. If a driver repeatedly rejects ride requests without accepting their account may be suspended for a review.
  5. By using the MEE CABS platform, the driver agrees to adhere to this strict no -cancellation policy. Non- compliance will lead to permanent account termination.

     

 

Driver’s Behaviour:

 

  1. As a Driver, you adhere to:
  1. Ensure the confidentiality of your account.
  2. Not consume alcohol or drugs, or be under the influence of drugs. MEE CABS has a zero-tolerance policy in respect of use drugs, alcohol intoxicants or the other illegal substances, by any driver and the users can report any such behaviour to MEE CABS and strict action will be taken by MEE CABS including but not limited to suspension of your services/your account while under investigation and termination.
  3. Avoid illegal activities and substance use while providing services.
  4.  Not try to harm the customer in any way.
  5. Not disrupt the Platform or misuse content.
  6. Use compatible devices.
  1. You consent not to share or upload:
  1. Unauthorized or harmful content.
  2. Information which is harmful, offensive, harassing, obscene, pornographic, invasive of others privacy, hateful racially or ethically objectionable, relating to encouraging money laundering, or gambling or an online game that causes user harm, or otherwise unlawful in any manner or promoting enmity between different groups on the grounds of religion or cast.
  3. The information that harms minor in any way or is harmful to child.
  4. The information that Threatens the unity, integrity, defence, security, sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
  5. Misinformation or illegal promotions.
  6. Violating the intellectual property rights.
  1. Violations may lead to immediate termination of access.
  2. Adhere to legal working hours and take mandatory breaks.
  3. Provide necessary identity documents for background checks.
  4. Spot inspections of your Vehicle may occur for compliance.
  5. The driver consents to provide identity documents as required under MEE CABS policy for background checks by the company, directly or indirectly through a third party appointed by the company.

 

Representations, Warranties and Covenants:

 

  1. The Drivers represents:
  1. They have the authority to perform their obligations here;
  2. Their actions do not violate any agreements or laws; and
  3. They have not been convicted of crimes involving moral turpitude.
  1. The Drivers further represent and warrant:
  1. They have the authority to operate the Vehicle without restrictions;
  2. They hold all necessary licenses and permits to provide services;
  3. They adhere to Motor Vehicles Act, 1988 and other relevant laws;
  4. They have not been convicted of cognizable offences in the past three years
  5. They will maintain up-to-date licenses, and insurance, and keep the Vehicle in proper condition. They will not drive recklessly, adhere to traffic laws, refrain from consuming intoxicants, and always have a valid driving license while providing services. They will not take calls while driving except in safe conditions, maintain professionalism in appearance and conduct, fulfil duties diligently, and avoid carrying weapons or engaging in fraudulent activities.
  1. The Vehicle must have valid permits and adhere to all applicable laws to ensure customer safety and satisfaction.

 

Relationship Between the Parties:

  1. The Driver must keep all Confidential Information private, including Customer details, and cannot share or sell this information.
  2. "Confidential Information" more elaborately refers to private data such as customer data, sensitive negotiations, services, and technology.

 

Proprietary / Ownership Rights:

  1. The Company retains all Platform rights, including content and design.
  2. Rights not granted remain with the Company; personal usage is the user's responsibility.
  3. Company trademarks cannot be used without permission.
  4. MEE CABS Application grants a limited licence to the driver on one personal devices.
  5. The Driver owns their inputs but grants the Company a non-exclusive license for service improvement.
  6. The Company may collect anonymized data for performance statistics.
  7. The Driver fervently complies not to:
  1. License or sell the Platform,
  2. Amend it,
  3. Create links to it or
  4. Reverse engineer it.

 

Indemnity:

The Driver will indemnify the Company against claims due to breaches of these Terms.

 

Disclaimers:

            The company makes no representation, warranty, or guarantee as to the reliability, timeliness, quality, suitability, availability, accuracy or completeness of the services provided by the MEE CABS and/or the platform.

  1. The Company provides the Platform “as is” with no guarantees.
  2. Warranties are excluded, and users assume all risks.
  3. Recommendations do not constitute professional advice.
  4. Access to the Platform may be affected by internet issues.
  5. Neither party here to will be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by among other things, strikes, lockout, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.
  6. In the event of any accident, the driver is solely responsible for any damages, injuries, or losses caused to themselves, passengers, third parties, or properties, or property.
  7. Drivers must ensure that their vehicle and themselves have valid insurance as per local regulations. MEE CABS is not liable for any claims arising from accidents, and drivers must handle all insurance-related matters independently.
  8. MEE CABS expects all customers to behave respectfully with drivers and follow platform guidelines. However, MEE CABS is not responsible for customer behaviour during the journey.
  9. MEE CABS shall not be held liable for any financial, physical, or emotional losses resulting from a customer’s behaviour, misconduct, or disputes between the driver and the customer.

 

Limitations of liability:

  1. The Company is not liable for the Driver’s actions or vehicle quality.
  2. MEE CABS is not responsible for vehicle damage or lost items during rides.
  3. Liability for disputes rests with the Driver.

 

Termination:

  1. The Company can terminate for non-compliance without notice.
  2. MEE CABS in addition to its right to terminate these T&Cs, in it is sole discretion reserves the right to legally prosecute the driver immediately, if there is reason to believe that the driver has indulged in any fraudulent activity or contravened the T&Cs of the platform or violated any applicable laws and MEE CABS will not be responsible for any consequences to the driver arising from the same.

 

Governing law and Dispute Resolution:

  1. Governed by Indian law; disputes are settled in Hyderabad courts.
  2. Amicable resolution is encouraged, followed by arbitration if needed.

 

Assignment of rights:

Drivers cannot assign rights without approval; MEE CABS can assign rights without notice.

 

Amendment:

MEE CABS may amend Terms & Conditions and will notify of material changes.

 

Severability:

If any part is unenforceable, the rest remains valid.

Notices may be sent through the Platform or designated communication channels
